Repercussions of minor contravention?:

This is a very interesting topic. My current partner had been involved with the children for 6 months prior to the X leaving the state. In that time she helped look after their basic needs and interacted very well with them. I have learned something here and will ensure that my partner is included in the parenting orders for the Final Hearing. Nothing has been mentioned by either party about this to date but I want to be proactive.

sending children interstate to visit their dad:

I had 3 1 day visits with my children interstate as our youngest was only 4. This gave me the opportunity to re-establish the Father - Child bond. Now the children are coming to the state where I live for about 3 weeks over the Xmas school holidays. I am paying for their flights and also my X to fly down and back as well. As our youngest hasn't been away from mum for an extended period having her close by at one of her friend's places is a good thing

Adding my name to the birth certificate?:

I'm fairly sure that only a Court ordered DNA test is acceptable and the cost is somewhere around $1600 per test. There are to many variables in a "home kit" and private testing without the consent of the court. On a side note scientists in Israel have shown that DNA evidence can be manufactured in a laboratory. Interesting stuff!!!!

Minor Name change :

You're daughter could be "known as Smith" at school etc. It is not an official name change and is quite common when I was with my ex her daughter from her fist relationship wanted to use my last name as the other children were at the same school with my last name. While I was flattered I felt a bit uncomfortable for her father. Long story short the ex went to the school and changed it with them Known as.

Procedural Hearing

Well I had my procedural hearing (Application in case) to have the lot moved interstate. On the up side the FM said no to an iterim hearing later this year. The FM did however say if the Respondent's Lawyer could get an earlier final hearing date interstate than set down it would be moved. To finalise the process I guess. Interestingly the FM did not have a copy of the Respondent's Application in a Case or Affidavit. The FM asked the Lawyer the date it was submitted, the lawyer didn't know I told him the date and he said "at least someone knows what is happening here".

The Lawyer seemed disorganised and took a lot of time to answer simple questions most of which the FM thought were flimsy by his responses. He explained to me that it would be in all parties best interests to have a final hearing as early as possible. I wasn't disappointed with the outcome and hope the Lawyer is still disorganised for the interim hearing. Fingers crossed but I am not getting over confident and will continue to cross reference affidavits etc for questions and build a strong case for my parenting orders.

War Declared on rollback:

I hope common sense prevails and the status quo remains. Statistics are flawed, manipulated and edited to suit those who choose to use them. A petition of approx 3500 parents is enough to have current legislation rolled back? In a nation of over 20 million people I would hope not. The Mainstream Media seems unable to be subjective in the area of shared parenting.

Seeing the children

Well I saw my children for the 3rd time in 5 months last Saturday. The time together was quality and not quantity. The all were happy being with me for 7 hours. It isn't much but you have to make the most of what you have. This is what I have to do for these visits. The children are interstate so it is a round trip of 2050kms. I leave on Thursday drive for 9 hours then stay in a motel. On Friday I drive for 4 hours to a friends place. I get up at 6am on Saturday to drive to pick up the children at 9am.

We spend time together until 4pm then I drive for 4 hours stop over in a motel and get up on Sunday morning and drive back to Sydney. Thank goodness I have a Procedural Hearing in November!!!

I love seeing the children. It has without sounding mushy filled a "gaping hole" in my heart. I am hoping that the FM will increase access so that the kids and I can continue to grow in our relationship. By the way I did a course in communicating with children due to the time gap between seeing them which was initially 18 months. It helped immensely and held weight with the FMC.

I would recommend that any parent do a course of some sort to do with children before or during any court action. It shows the court you care enough to go out of your way to "learn", thus benefiting the children and yourself.

Psychological assessment of parents in custody cases:

This is a very delicate area I suffer from PTSD and did so for the last 3 years of my former relationship. It was never a problem whilst we were together, nor whilst I had our children until my ex moved interstate. As it is going through the courts now as I expected it is been used against me. I was honest and put the condition in my affidavit. I won't go into great detail but my ex is demanding frequent letters of mental state from a psychiatrist. I don't believe this is necessary and am requesting 1 letter outlining my mental state. Which is quite good actually

Family Consultant Report weighting:

I have a Family Report due before my final hearing in mid 2010. After reading the posts here I have some hope that it will be a fair assessment and be in the best interests of the children. I have a Procedural Hearing in November and hope that some reasonable arrangements can be made. I have doubts about that but I am always hoping for a fair and reasonable outcome.
