A visit from the Police!:

What the police did in this instance is called a welfare check. They visit the home and they have to visually chaeck that the children in question are OK.

When seeking orders by consent or otherwise:

The AVO is on the grounds that, I may take the kids out of Australia.

This is not likely since I do not have a current passport and, as far as I know, the kids don't either.

The police are seeking a condition that I do not contact her at all. To me this seems that it interferes with the order for the shared and equal responsibility for the long term care of the children. Funny enough this part of the order was left out of the info given to the police. Hopefully I can have this dismissed with out too much trouble.

Hi guys, just a quick update on my situation.

Got interim orders on the 23/8/7 that states some of the following:

Equal and shared long term care for the children, contact on the 25/8 from AM till PM, and then on 2/9 and every 2ND Sunday thereafter from AM till PM.

I had the contact on the 25/8, then some new allegations thrown my way by her lawyer during the following week on the phone but nothing in writing. Her lawyer said something using their right of reply with in 7 days to oppose the orders. Nothing has been lodged with the FMC according to the court file. No attempt from the order side to facilitate contact as per the orders, on the 2/9. Worst part is that I have to wait for the court to send out the orders before I can file a contravention of the orders.

Also found out last night that the police are trying to serve me with a summons to appear in court on the 12/9 for an AVO mention. Don't have all the details as I have not yet been served with the summons. will advise when i have full details.

I contacted a FRC centre, and have not heard back from them. I have spoken to the mother of my children, and her response was " I'm not going to do anything about the current situation", and her lawyer says just about the same thing.

I have only seen my girls 1 since Ausgust 06, and try calling once a day, but have only spoken to them once in the last week. have spoken to them on many occassions. When they 1st moved out the children used to ring me. that has stopped since my birthday.

I am trying to get my documents in order with the help SRL Resources, so I can file in court.

there is only one property, it was the family home. because the other party is waiting for me to file in court, they will not do anything or agree to any proposal that i put forward.

thanks for the info, i will read over it a few times to try and fully understand it.

CSA change of Assesment

I recently put in an application for change of assesment, as I felt that under the 10 points for a change I have good grounds. I went with the point that I am still paying off a joint loan that is not for leisure purposes.

To my dismay, got a phone call from he CSA advising me that because the children are not living in the home that I am paying off, even though it is a joint loan, chances are that I will not get a reduction in the amount of CSA that am paying. Even though I am starting to struggle with my finances. CSA also advised that if I was to continue with the application, that most likely the outcome would be against me. So I withdrew the application.

This now poses 2 questions to me,1 -  what will they do with the information that I have supplied?, 2 - and if they use it, how long before they hit me with a change on assesment?

Please bear in mind that a change of assesment takes up to 72 days to be fully processed, yet when I lodged my last tax return, I was re-assesed in 10 days:o, and my payments went up.  :(

This is a great idea as I need all the help that I can get, before I can get to court.

I suppose that for this to be really effective it may need to be very close to a court scene. (Just my opinion.)

Follow up Lane & Arthurs - Residence Reversed:

as a dad who is fighthing for my children's and my rights, the ending of this story sux big time! the children are now with out the mother, because the she did do what was in the best interest of the children.
How stupid can some people be not to do what is in the best interest of the children.
At the end of my battle, all that I want is what is best for my children, and that is to have contact with both parents, and both families.
I trully feel sorry for the children in this case.

I have met Tony in person, but  yet did not thank him in person for starting DIDs. As a dad going through and enduring the whole torture process from the mother of my children, I have only seen my two girls once till today, I am thankfull that I found DIDs early on in my seperation. I would say that if it wasn't for DIDs, i most likely would not be here.

As a result from my interaction with DIDs, I am now a facilitaor for a DIDs group. I have used Chrystal's story with many guys who have not yet accpet the feelings that come with being in this situation. I use the story to remind them that they need to fight for the children as they need to see that both parents care, regardless of what the other parent may be saying. There only needs to be one Chrystal.

Thanks Tony for starting DIDs. one day I might be able to say it to you in person. There are lot of stories out there, and they need to be shared with the masses so, the dads who are lost may find a compass, and the people that know someone who is in this situation can release how bad things are for some of us.

When seeking orders by consent or otherwise

I am in the process of trying to work out what I want included in my orders. My main question is this, do I ask for what I can deliver now, in terms of care or contact? or do ask for more time that what I feel I can provide for?

I am asking because what I ask for in my consent orders, is most likely what I will ask for in court. I do not want to get to the court and ask for 50/50 as I feel that I can not deliver the care. On the other hand I feel that I can deliver care on the 3 nights out of 14 that I am thinking of asking for. Any constructive feedback will be much apreciated.
