What financial information to give to your lawyer

Well, it has been a long time between posts - almost long enough to have a family law case finalised in the Family Courts.
I promised you information on what financial information your lawyer will require.
You will need to provide your lawyer with all your financial information as this is required for full financial disclosure to the other side. If you do not, you could be penalised.

Dealing with a lawyer can be time consuming and expensive. The two go hand in hand, so it pays to save time. The best way to save time is to be prepared, this is especially so in financial matters.The best way to be prepared is to have a financial statement filled in.
However, these forms are not easy to fill in and there can be serious consequences if you do not do it correctly, especially if you are facing a spousal maintenance claim.If you cannot fill in the form, you should at least provide your lawyer with the information that the financial form is requesting.

Your lawyer will need from you the following:
  • All bank & credit card statements for the last 12 months
  • All mortgage statements
  • All super statements, especially the end of year one
  • Your last 6 pay slips
  • Your last 3 tax returns
  • Information about any business that you have and related bank statements
  • Shareholder agreements for the business
  • Details of any family trust
  • Property and other assets that are overseas
  • Information about any loans from parents and any loan repayments that you have made
Full details of your assets and liabilities, including those of your partner. Assets include all the following:
  • Car
  • Aircraft
  • House
  • Investment property
  • Business
  • Shares
  • Leave that can be cashed in
  • Boats
  • Paintings
  • Collections of any sort (medals, coins, dolls, books etc)
  • Silver & gold
The above lists are not complete but they give you a very good idea of what to include.Your lawyer will also need to know about assets that you have sold during the last 12 months.
