The Federal Magistrates Court has released new divorce forms and kits to assist people applying for a divorce. Introduced by Practice Direction No 1 of 2007, the new forms include the:
- Application for Divorce
- Response to Divorce Affidavit
- Affidavit of Service by Post (Divorce)
- Affidavit of Service by Hand (Divorce)
- Acknowledgment of Service (Divorce)
- Affidavit Proving Signature (Divorce)
The new forms do not result in any substantive changes to the manner in which divorce proceedings are conducted in the Federal Magistrates Court.
The forms are accompanied by a new Application for Divorce Kit and Divorce Service Kit. The kits include all the forms required to apply for a divorce and serve a divorce application by post or by hand.
The forms and kits are now available under the "What's New" section at www.familylawcourts.gov.au.
Printed copies of the kits will be available in family law registries on 5 February 2007.
From this date, practitioners can bulk order the kits from the website.
The Court will accept the new forms for filing from 5 February 2007. Old forms will be accepted until 30 June 2007. See Practice Direction No 1 of 2007 at:
