Ex went against Court Orders

Hi,
My ex went against court orders.I told her I was flying up to see my daughter (like I do every month for the last 5.5yrs) she said yes but its the last time(long story coz i reduced child support as I couldnt afford what she wanted me to pay) so i booked my flights and accomodation (i live in Syd,she lives in QLD) then a day or 2 before im suppose to fly up she says no you wont see her,but I went up anyway and went to pick up my daughter at her school,they said she wasnt been in for 2 day so i went to police and they said they cannot make me ex give my child to me even thou I have court orders.

What can I do without going to court?I know Family relationship centres do mediation but my ex has many unstable issues and she know I will need to go to court to take it further.I feel jailed and she has all the control and is teaching my daughter to hate me.What can I do,is it hard to get custody if my ex contravines court orders?will judge just slap her wrist and give a warning only?

I am writing things in a journal,she has cost me nearly $1000 for that trip and I didnt see my daughter.I pay approx 12,000 per yr to see my daughter and I cant even claim it in CSA coz the judge wrote in the orders that I am to pay for the cost of see iing my daughter so now CSA wont deduct an amount for this…..which is just so incredibly crazy.

There is not much you can do unless your daughter wants to live with you and she is old enough to make the move. As you have court orders you can either file a Contravention or a Recovery Order but you are right, she may get a smack in the wrist.

You can use the search button to find recovery orders. What you want here is a contravention proceeding if orders are not being adhered to. The local Police are in most cases (but not all) reluctant to get involved in enforcement of Federal orders… Again the search button will give all the answers you are seeking.

What I was interested in was how is the Child Support being paid? Through the CSA? as if it is you may well be able to offset these high costs of contact as you are probably in the bottom band of contact less than 52 nights by the look of things.
