Ok i was wanting some advice as to whether or not i should file a contravention order. He has broken the intrim order quite a few times. They are minor issues like, not. Informing me of doctors and councillor, has missed phone calls, hasn't shown kids how to reply to email i set up for us. The last school holidays he didn't send them with any clothes at all. Only what they were wearing. I know that has nothing to do with orders but this is the type of person (slept with err) i am dealing with. ? ? Next court date 3/12/12 for trial directions. What to do apart from freak out.
Thank you. It just really hurts. Some days i feel like my connection with them is not as strong. So next question. . . . What type of things need to be prepared for trial direction hearing. I think i get the gist of it. For example with people i want to. Subpoena. Do i need to inform the court on what type of questions i want to ask. Also, not sure of the name of the form but i need to look At ex's subpoenaed Psych records etc. Does anyone know name of that form and will i be allowed to look At these documents.
My kids live with me, however my ex has a tendency to not want to return the kids at the appropriate time. For example, most recently last night, she told them not to leave the house when I arrived. Long and the short, my two boys had to evade her and escape the house by running out the back door and around the side to my car. Prior to that she has refused to return them because she wanted them for the monday of a public holiday, rather than return them at the end of her court ordered weekend. She has also previously withheld them until I agreed to return certain belongings to her (she was welcome to them).
Do I have enough to initiate a contravention? I have COPS event numbers for the above instances. Do I need to subpoena the police records for my affidavit? Or can i use Freedom Of Information requests?
