Final Hearing Over!!! THX to Verdad! Monaro! Iysus! Evryone else!

Hi all,

My final hearing finished yesterday.

I essentially got what I wanted.

Just wanted to take a moment to thank the following FLWG members:

1. Verdad Thank you for caring. For making yourself available to offer advice, pearls of wisdom and knowledge - even while away on holidays in QLD when I'm sure he would rather be chilling out! For redirecting my focus when I got distracted. For playing Devils advocate. Verdad has struck through this journey with me now for 9 months or more. He has demonstrated tremendous character and depth as a human being. I am forever in your debt.

2. Monaro What a ledged! This bloke sat in the court room most of Wednesday and yesterday, taking notes, giving feedback and support. He balanced out the numbers. Added weight. Helped influence negotiations in my favour. Rolled his sleeves up and got stuck in. Won the respect of the Mother's counsel and the ICL in the process. A brother in arms. I am forever in your debt. And I look forward to colaborating together on his matter. I don't think I could have made it through without you there. Thanks for being there, mate.

3. Isys Fielded a call from me Wednesday evening as I needed help tracking done a judgement supporting 'equal time' in the context of poor communications between the parties. The judgement he provided me was spot on and gave me the confidence to hold my ground in negotiations. And I look forward to colaborating together on his matter.

Brothers in Arms! I won't forget.

Obviously there are many others out there who I need to thank and you know who you are.

I am going to chill out for the rest of the day. Having major problems winding down. Its been a big week!

The Final Orders are being handed down at early this afternoon.

Well done 4myD. This should inspire those who are still in the thick of it. There is light at the end of the tunnel (and its not always a train.) :thumbs:

The last two days have certainly been a learning experience - a steep learning curve.

I just got back from the Family Court with the Orders in my hand. The orders were given 'ex tempore'.

Fowler J gave his reasoning orally. I gotta say, Justice Folwer is awesome! He is a real human being and appears egoless. He is very gentle and seems to go out of his way to make a personal connection with the parties. I hope others have the good fortune to have thier matter heard by him.

I shared about an hour this afternoon with the ICL and the Mother's counsel. We shared some story's and had a laugh.

They were impressed by our effort. When I say 'our' - I include Monaro. They were highly complimentary of Monaro. They told me he should be practicing Family Law! That must be a vote of confidence if ever I've heard one!

…. so from tomorrow.. the unsupervised contact commences and I have my daughter for 6 hours… what shall we do?

Mate so happy to hear your good news, well done I know you had some fantastic support but you had the heart and courage big congrats.

I bought my daughter home today and we draw pictures. There is a ton of draft court documents laying around the study.

Together, we draw on the otherside of my numerous draft Case Outlines.

I thought that was a strange - and satisfying - irony!!!

All too true and no doubt it will not be the last of such events, I know when my girl came back after 4 months it was a little scary for the first twenty minutes then we just melted into just being us, it gave me a warm feeling for days, I was just on a different plane and my fathering side was just complete, when the orders did come there was a bit of an anti-climax as well though which threw me out for some time so stay well and talk often but the best thing is she will be back soon. Enjoy.

Thank you for sharing with us 4mydaughter. As we {I say we… my son & myself} have just established regular contact with our Little Miss after weeks on end of not seeing her. You will find other posts by me if you care to look.
Final hearing for this case will be in November so it is good to read the positives from a father's point of view.
May God always watch over you and your daughter.

Yes - I can say that I have had some very dark moments at times.

At times when it feels all hope is lost, it is important I think, to remind yourself that the law (section 60CC) is on your side (well the child's actually).

It is important to remind yourself, that there is a presumption of 'shared parental responsibility' which can only be rebutted if there is abuse or violence. And any abuse or violence has to be significant and relevant. Any 'Risk of Harm' to the child has to be 'real', 'substantive' - before the court would deviate from 'shared parental responsibility'.

Lets not forget - the child has the right to be cared for by both parents.

This 'policy' should provide hope and confidence to any parent.

(Unless of course you are the type of parent who does not want to share!)
