Help needed in getting custody agreement through the court system

Could anyone offer some advice in regards to the process/procedures to be taken to have a custody agreement formalised through the court system?

I have sought to mediate an out of court agreement through the correct mediation procedures, however the other party declined and I have now received a certificate for the attempted mediation allowing me to take the next step of getting a court ordered custody agreement in place.

This is a fairly urgent matter for me as we had an agreed visitation schedule, however whenever the other party has alternative plans or there is a disagreement, she cancels the visitation without notice.  For the past 5 weeks she has refused visitation due to a disagreement, therefore we have not seen my children for that period. Both my wife and myself have spoken to the children each week and it breaks our heart when the children say they miss us and want to come over.  Can anyone please help?

As I will be representing myself, I am in urgent need of any possible advice or assistance to get the ball rolling.
Kendall, you might spend a little time reading the 'WEB Guide' area as well as the forums as many of your questions have already been answered.

Some advice, do NOT use the term 'Custody' here or in a Court. Its usage tells us you are 5 years behind the times.

You have made a great start in finding this place.  :-)

Are we to understand that you do not have any court orders or registered parenting agreement place? If so than it is probably wise to start researching and reading through the family law website Family Law Courts Homepage and on how to make an application in a case.

There is a lot of Self Representing Litigator material available here as well.

I had a similar situation in 2007 where an informal agreemnet for supervised contact was in place but not being adhered to by the mother. My daughter was absent from contact for a period of 8 weeks at one stage. Fortunately, I was able to 'hijack' a directions hearing, where I put the Judge on the spot and got her to formalise the arrangement by making Orders.

Your former partners actions indicate malevolent tendencies. Watch your back.
