Equal shared parental responsibility

In our court orders, our soliciter has put #2 as The father and the mother have equal shared parental responsibility for the children.

She explained to us that this is a presumption and goes with out saying but has put it in because the mother wants sole parental responsibility.

At mediation these orders were presented to the mother she has circled equal shared stating that the wording is wrong and does not agree and will not sign.

Can any one tell me if  our soliciter has worded this wrong or the mother is is being difficult, please?

Definitely the latter but I'm sure the basis of her objection will come out in the mediation.

The Solicitors wording appears consistent with other orders I've seen. Good that your solicitor added it as a matter of course as in many cases where any detail is not explicitly mentioned then it may as well not exist. Hold your ground as it's easier to give something than it is to get something back.

"I know that you believe you understand what you think I said, but I'm not sure you realise that what you heard is not what I meant."

 
Even Judges (ex FMs) are asking where the order is, if you do not put it in. See the wording of S.65DAA.

The mother probably thinks it means 50/50 care.
All I have to say on the subject is you might have bothered to actually do a search on the site using any of the search buttons.

Yes equal shared responsibility should definately be left there. 100%

No wonder the moderators sometimes get very frustrated especially since the orignal poster has been a member of this site for over 8 months.

Sole Responsibility means she can make all the major decisions, Equal means decision sharing about major issues which way do you want to go?
