Emails as annexures?

Request for best practice when including emails

This question is in part kicked off by another post request how to do text messages.

I have had a long series of emails back and forth. Something like 8 emails and none of the emails were particularly short.  So if i wish to include them as annexures, do i print each separate email and treat as a separate annexure, or do i print the last one which is obviously very long and would need to be read backwards, if you know what I mean.  When I separate them, would it be OK to have just the content of that individual email without the email that is being responded to on the same page?
So, to my thinking, the individual email would be easier to read, but may not give context as the other email is a separate annexure. 


So with emails, what is the best practice?

1a. Yes. Each email should be a separate annexure. In your affidavit you would be reference each individual document. (i.e. "A true copy of email from the mothers dated xx/xx/xx hereinto attached and marked as annexure "X")

2b. Yes. Its how you do it. Your main aim is to make it easy for a Judge/Magistrate to follow the evidence.

You could print out each individual email and annex them each in chronological order. If you really wanted to cover your bases (i.e. in the event that the mother challenges the emails), you could also include the entire 'email thread' in a single document behind the single copies. Or you could submit the 'email thread' as an 'exhibit' separate from the affidavit.

referencing annexures - seeking clarification

Just to clarify about referencing annexures,

So i write in the affidavit as follows??

16.   Consent Orders were agreed and registered with the Family Magistrate Court on DD Month Year.   A true copy of orders hereinto attached and marked as annexure A.

17.   An email was sent on dd/mmm/yyyy stating that XXXXX planned to contravene the orders.  A true copy of email from the mother dated xx/xx/xx hereinto attached and marked as annexure B.

18.   On dd/mmm/yyyy several emails were exchanged between the mother and I attempting to negotiate holiday arrangements.  A true copy of email exchange between the mother and I dated xx/xx/xx hereinto attached and marked as annexures C,D,E,F & G.

19.   Between 01/mmm/yyyy and 05/mmm/yyyy several emails were exchanged between the mother and I stating………  A true copy of email exchange between the mother and I dated 01/xx/xx hereinto attached and marked as annexures H & I. A true copy of email exchange between the mother and I dated 02/xx/xx hereinto attached and marked as annexures J & K. A true copy of email exchange between the mother and I dated 05/xx/xx hereinto attached and marked as annexure L.


And another question - do you staple the annexures to the affidavit?  How thick can affidavits and annexures get?

Basic question, i know, but I just want to be sure.

17.   An email was sent [by the mother and received by me] on dd/mmm/yyyy [indicating her intention not to facilitate our daughters/childs time with me pursuant of order XXX or words to that effect][A true copy of email from the mother dated xx/xx/xx hereinto attached and marked as annexure B].

18.   On dd/mmm/yyyy several emails were exchanged between the mother and I attempting to negotiate holiday arrangements.  [A true copy of email exchange between the mother and I dated xx/xx/xx hereinto attached and marked as annexures C,D,E,F & G.]

19.   Between 01/mmm/yyyy and 05/mmm/yyyy several emails were exchanged between the mother and I stating……… 

[A true copy of email exchange between the mother and I dated 01/xx/xx hereinto attached and marked as annexures H & I].
[A true copy of email exchange between the mother and I dated 02/xx/xx hereinto attached and marked as annexures J & K.]

And another question - do you staple the annexures to the affidavit?  How thick can affidavits and annexures get? Staple to Affidavit? Yes. Generally affidavits should be more that 2.5 cm thick.
