Vent at the Bench

Iunderstand how you feel. I am in the same position.If you take the matter to the High Court there is the possibility those Judges will cover up for that Judge so you will most likely suffer more tortureincluding hugh costs.I was advised of this by a lawyer. Judges tend to support one another.You would need a really good Barrister prepared to stand up and apply the law. The practice of Family Law in this country is unethical and abused.There has to be another way to expose the injustice alot of us are experiencing. Individuals taketheirmatter to court expecting a service,to have the Family Law Act applied, but it isn't in many cases as we know.There are many cases to support that fact. Judges are not accountablethey can say and do whatever they like it seems.The mental health status of many of theseJudges is questionable.I believe many of them should not be on the bench. They lack skills and knowledge in administeringjustice.

I don't believe you are in a position to be questioning the mental health status of those on the bench. It has to be remembered that the judiciary must act within the confines of the legislation, I am sure that there are occasions that the judicial officers make decisions they are not comfortable with, however they can not step outside the legislation. It is the role of the advocate (SRL or Legal Practitioner) to do their homework so they can balance legislation and judicial reasoning methods which will allow the judiciary to carefully consider their proposals.

There are different ways of looking at things, and one way is, yes, many of these Judges may have mental health issues. I think I am well qualified to make that comment, and I am.  How would one know if a Judge has mental health issues?  What makes Judges immune to mental health problems?

As you say Liberi Primoris the Judiciary must act within the confines of the legislation.  Are they?  Definitely not in many cases. This is a fact.  We have proof of many cases of this not happening.

Yes I agree with you Liberi there would be many Judges who have made decisions which have caused them discomfort, and made within the law.  However, there are many judgements which are inconsistent and way off and not in accord with the law which I'm sure have caused discomfort (hard to believe) to those Judges too.

Regardless of a good case or how it is presented, the role of the Judiciary is to look at all the evidence, weigh it up, and apply the law.  The reality is this is not happening in alot of cases. This is fact.
