Legal Rights for Grand Parents

What legal rights do grandparents have under the changed legislation? Are their rights tied up with the parents or totally separate?

What legal rights do grandparents have under the changed legislation? Are their rights tied up with the parents or totally separate?

For example: let us assume that ex wife & husband have 50/50 share; what share do the grandparents have?
What cases and judgements have come from the court system. What if only one set of grandparent is close by, alive or in in Australia?

Grandparents never had 'rights' (nor do the parents) but children have the right to……… etc

Traditionally Grandparents were significant adults (whom the Courts recognised) The wording changes to the ACT including using the term 'Grandparent' were good for the 'grey' vote. In essence it has made no difference to Court outcomes because the Courts have traditionally accepted that Grandparents play a role in the lives of children.

For the last few years some of the older judges who would have had significant contact with their own grandparents and the influx of many immigrants whose family ties strongly revolve around Grandparents has made it into a non issue in the Courts

If you have 50/50 then the Courts would assume you would each take care of the respective Grandparents contact time (failing a specific order) or if the Grandparents are located geographically away then facilitate telephone, mail or web cam contact.
