I have never had contact with my only grandchildren now 4 and 2 years of age who live only 10 minutes away by car. I have never seen them not even a photo. I am a grandparent denied contact with my grandchildren by their own mother, my daughter (only child) through no fault of my own.

I took preliminary steps in seeking a relationship with my grandchild (before my second grandchild was born)including counselling with my daughter and two attempts at mediation, but my daughter refused to participate. No alternative, I filed an Application to spend time with my grandchild in the Federal Magistrates Court.A mediation session supervised by a Court Counsellor was ordered but my daughter relied on fabricated allegations of abuse and refused to participate. (As there was no abuse this was not anticipated).

I applied for Legal Aid and was refused as they said my case had no merits (in contradiction of Legal Aid's policies). Legal Aid's attitude socially excluded me from any legal assistance including pro bono and I was forced to self represent.

During the Final Hearing, my daughter's Barrister run's the case that I am vindictive and vexatious in bringing the matter to court and he and the ICL Barrister argue that I should have known better. Both ask for costs against me. In a nutshell the Federal Magistrate ignored me, my evidence and refused to hear me shutting me down (I may as well have not been there) and relied on fabrications, assumptions and impressions to justify dismissing my Application ordering costs against me. I appealed, again self represented, (Legal Aid's attitude had not changed) as I was unable to locate someone willing to represent me.

At the Appeal Hearing, I was abused and humiliated by the Family Court Judge shutting me down. My Appeal was dismissed, the Judge relied on fabrications and assumptions to justify the dismissal of my Appeal and to deprive my grandchildren from knowing that I exist, and more, ordered further costs against me.

I am the children's only living biological maternal grandmother. The children have no grandparents living on the other side. Worse, my daughter has my grandchildren calling someone else "grandma" a mother of one of herex-boyfriend'swhen I exist. The Federal Magistrate and the Appeal Judge failed in not applying the law, and by not giving valid reasons for dismissing my application depriving my grandchildren from knowing me and their extended family. Instead, they ignored the Family Law Act 1975 and relied on created fabrications, false allegations and assumptions (a character assassination of the grandmother) to deprive my grandchildren of a relationship with me potentially harming any future relationship I and my grandchildren may have. A McKenzie Friend (from this site) was present throughout my Hearings who in a submission about my case to the Federal Attorney General wrote "A common tenant of our legal system is that Justice must be done and seen to be done. Justice did not happen in Ms…………………..'s case.


I am just one of many grandparents denied contact. This issue is so widespread and growing everyday a lot more than realised. Many grandparents are suffering in silence and are too scared to speak out or do anything about it especially when they hear and know what is happening in our courts, like what happened to me, and others.

I am feeling reluctant to encourage grandparents to go to court now knowing that the law is likely to be abused, the children's rights ignored, the grandparent abused and character assassinated, and punished with costs ordered against them, causing injury, pain and suffering to them, and making matters worse.

Visitation for grandparents.

Hi…..I have just completed a spell of mediation and got my ticket to go to court. I must go to court, due to mediation being unsuccessful, but I am a little scared to do so, at present.

I have tried to do some research on wether it's possible to achieve visitation from a court room, but at the end of the day, what the Judge chooses, is unknown.

Due to my daughter in law (who is still married to my son) being told by her solicitor to use the stress card if forced to go to court, I am concerned. Her solicitor told her why a Judge would say No to me, which I saw whilst having mediation.

I wish I knew what the odds were of me getting visitation rights from a court room.



Can anyone offer me some advice please!!!

Can you elaborate a little more?  How old are the children?  Have you seen them before?
