Child Violence Forum attended yesterday

Child Violence is increasing. You will no longer be allowed to make contact orders for children through the Children's Court begining 2010

Child Abuse is increasing.

Risk Factors, Drug, Alcohol, Abuse of children out of control.
Risk Factors - Mental Illness, Depression, post natal depression, young age of mother.
In terms of Child Development the earlier the intervention those children assisted or removed do better if removed before age 4. If child reaches 4 the child becomes a high needs child.
While foster Carers get more funding from the government than Kinship carers this disparity is presently under review.
For those not aware there is a Kinship Carers Allowance offered by Docs. Grandparents (Kinship Carers) are their for their own grandchildren and (may) need to let go of their own child. (Pru Goward MP)

An alarming Development is happening from next year 2010 which is unjust and about to be passed in the next few weeks.

You will no longer be allowed to make contact orders for children through the Children's Court begining 2010. Anyone against this is asked to write letters to their local and federal MP's (Leonie Miller, Children's Court Lawyer).

Junior Social Workers 25 year olds from Docs have decided this. They no longer want to do the work involved.

Can you provide some background to this for our readers?
  • What is the current situation?
  • Why is it unjust?
  • Where are the draft changes to legislation and what ACTs are being changed?
  • Who or what department is driving this change?
  • Who is requesting these contact orders? and are any of these orders being requested in the Family Courts? If not why not?
  • Where will contact orders be made from January 1 2010? 
  • Who will be impacted? Carers, Parents? Grandparents?

I have attached an emerging issues template that we can take to Federal Government on your behalf. Please provide the above information and complete the emerging issue template if you want something further done about this.

I must say you make it incredibly hard for anyone to assist you, aside from getting to the bottom of what is going on. What do you want people to write? Do you have a sample letter? Who is Leonie Miller? A Children's Court lawyer where? at which court are they located at and do you have email and or phone numbers to contact this person? Is there any media material published about all of this?

Sorry to give you some work to do around the issue but more than happy to assist if we can get to the bottom of what is going on.

"Abuse of children is out of control" (Pru Goward MP).
Child Abuse is increasing. More and more parents are using drugs, alcohol, neglecting and abusing their children.

Risk Factors drugs, alcohol, mental Illness, depression, post natal depression, and the young age of the mother.

This is having an extreme impact on Grandparents, Kinship Carers and Foster Carers who have fulltime care of these children.

One impact is that many grandparents have become parents (again) to their grandchildren at a time when they should be enjoying their retirement and are missing out on this. They are struggling at a time in their lives to care for their grandchildren because of problems with their own children. Many Grandparents are struggling financially. Many have had to give up their jobs to care for their grandchildren and are not getting the support they need.
Grandparents, Kinship Carers need information, resources, respite and lots of support.

Foster Carers get more funding from the government than Grandparents, Kinship Carers; this disparity is presently under review.
There is a Kinship Carers Allowance offered by DOC's which many are unaware of.

"In terms of Child Development the earlier the intervention of an abused child before the age of 4 the better they do to go onto to a normal life" (Pru Goward).

"If intervention occurs at age 4 or thereafter the child's needs become higher" (Pru Goward)

While contact orders for children can be applied for in the Children's Court, an alarming development is occurring for Grandparents and is about to be past as legislation in a few weeks.

That is Grandparents will no longer be allowed to make contact orders for children through the Children's Court from 1 January 2010.

This is DOC's decision junior workers do not want to deal with the conflict between grandparents and their children.

Anyone against this can write letters to their MP's if they oppose Grandparents not being able to apply for contact to their grandchildren through the Children's Court.

What has led to this decision? If you can't make contact orders in the children's court do we assume all requests for contact orders are made in the family courts? Where do you go to get orders to allow the take up of parental control where parents are unable to care for the child?
