My ex does not let me to take our child overseas, she holds his passport

Hi, I have a situation and I don't even know where to start.

We've been divorced for a few years now, our child lives with my ex and spends weekends and some time on holidays with me. There are no court orders or parenting plans in place, nothing. Few months ago my ex applied for our child passport, I signed the application and she went overseas with our child. The informal agreement was that both of us can travel and take the child. BTW, child (son) is 9 now.

Now I want to go overseas with my new wife, new kid and take my first child with me. My ex didn't agree, was holding the situation back and refused to give me definite answer (mind you, she holds the passport). Today, out of the blue, she came up with new requirements - she wants to see a letter from my employer saying that I am employed and letter from the bank saying that I still have the mortgage. She says that her concern is that I may leave the country and take our kid with me. This is obviously incorrect, she is perfectly aware of my situation, she knows that I am not going to leave the country. I also don't feel comfortable with her coming with demands like that and I am not going to fulfill them.

It looks like this time my child will not go with me - my ex holds his passport and most likely she won't let him go. But I don't like that situation and I wonder, if there are ANY legal ways for me to obtain my child's passport and to travel with him.

Your help will be greatly appreciated, thank you. We live in WA if that matters.

I think that a court application is the only sure way to do this unfortunately. How long till you plan to go?
Unfortunately, judge CRONIN stopped my child to see my dying father and then the following week after he died the same judge refused my child to come with me for funeral overseas. This was to a country which is signatory to the hague convention and i took an oath on my dads body for KARMA and God's justice to strike as these people including the childrens lawyers, and the court child psychologist have NO HEART and its the most EVIL place I have ever been. They even made fun of my father''s medical condition… PLEASE IF YOU CAN RECONCILE out of court…. at ANY COST even if you have to back down… on some things.
