Information regarding the provision of transcipts, access to court recordings and associated costs

Details relating to the Court's Current Providers are as follows:
In March 2009, the Family Court of Australia and the Federal Magistrates Court awarded a national Recording and Transcription contract to Auscript Australasia Pty Limited.

This contract replaced Spark & Cannon (SA) Pty Ltd in Adelaide, Melbourne, Dandenong and Hobart Registries and Merrill Legal Solutions (NTS) in Brisbane, Townsville, Darwin, Sydney, Parramatta, Newcastle and Canberra Registries. In addition, Auscript will provide transcription services for matters recorded in all circuit locations in all states other than Western Australia.

The transition to Auscript commenced 1 June, 2009 and was completed 21 September, 2009. Dates for the transition of the six (6) remaining regional sites, Lismore, Coffs Harbour, Albury, Alice Springs, Dubbo and Wollongong are currently being finalised.

Provision of Transcript:
Please note that a Transcript can be purchased only by the parties to the proceedings or their lawyers.

The Transcription Providers will request documents such as Drivers licence and Passport (photograph, name, birthday & address) to verify the bona fides of any applicant. Solicitors would normally be the "solicitor on the record" however if a client has recently engaged new counsel, the solicitor would need to produce sufficient documentation to establish that they act for one of the parties. If a client has difficulty producing suitable identification, they can approach the relevant Registry to receive an authorisation.

Under its current records retention policy, the Court retains recordings for 10 years thus requests for transcript of proceedings beyond 10 years cannot be processed.

When requesting transcript, parties need to be aware that they will be provided with only the transcript of proceedings and the documentation will not include judgments, rulings or orders.

Availability of Audio CD-Rom of Court Proceedings:
In order to help it perform its role as a Superior Court of Record, the Court has arrangements with external contractors for the recording and, if necessary, the transcription, of its proceedings.

Such arrangements provide for parties or their solicitors to purchase a recording of their proceedings on read-only compact disc. However the recording, or transcript privately produced from it, is not an official transcript of proceedings and is not able to form part of an Appeal Book, but may help to decide whether an official transcript should be ordered. In all cases where a transcript is required, including appeals, an official transcript from the service provider must be ordered.

As with the provision of transcript, access will only be provided to recordings of proceedings, not judgments, rulings or orders.

Requests for the provision of a copy of a sound recording, in read only CD-Rom format, should be referred to the Registry Manager at the relevant location for approval.

Access to Court Recordings:
To reduce transcription costs, clients may wish to listen to recordings of their proceeding and select specific segments for transcription.

Applications to access recordings need to be made through the relevant Registry Manager clearly setting out the reasons a client wishes to access recordings. Access to recordings will be considered on a case-by-case basis.

With respect to accessing recordings, clients need to be aware:
The Court does not provide unsupervised access to recordings. This means that, should approval be provided to access recordings, you will need to visit the contractor's premises (in the capital cities of the States/Territories where they record for the Court) to listen to the recording or, in the case of Auscript, recordings will be accessed in Family Court facilities.

As with the provision of transcript, access will only be provided to recordings of proceedings, not judgments, rulings or orders.

Costs for the Provision of Transcript and/or Listening Facilities:
The costs associated with large amounts of transcription or dubbing audio records for supervised access can be substantial. It is therefore recommended that parties seek cost estimates for their requirements prior to placing orders.

In some cases, it may prove cheaper simply to order a single block of a proceeding from the outset, rather than ordering several smaller segments or listening to recordings and then placing a transcript order.

Prices are :-

Progressive Same Day = $5.00 per folio
Same Day = $4.50 per folio
Next Day = $4.00 per folio
3 Day = $3.75 per folio
5 Day = $3.50 per folio

A folio = 100 words. There is a minimum charge of $50.00 excluding GST.

  The Registry Manager is the person with the authority. The one who makes the decision.

It may be that in the Federal Magistrates courts it is the Magistrate that has that authority. With the marrying of the two courts that may have changed?

It is not the company effecting the recordings that makes the decision.

By the way ...

I think that people on this site ought to know that if final submissions have been made, a SRL would need to seek leave from the presiding judge in order to obtain a copy of the audio recordings.
