We fully support the media release posted by Warwick Marsh of the Fatherhood Foundation dated 2 May 2009.

Recent media reports have stated that the Chief Justice of the Family Court, Diana Bryant, appears to want to open the floodgates to a torrent of false allegations, with no checks and balances.

                                        Abolish the Family Law Court

Yesterday it was reported in the media 1/5/09 that the Chief Justice of the Family Law Court, Diana Bryant, had written to the, Attorney General to ask that part of the act dealing with false allegations be repealed.

Warwick Marsh from the Dads4Kids Fatherhood Foundation said in, reply, "Justice Bryant has not gone far enough. The whole Family Law Act should be repealed and the Family Court should be disbanded. This organisation has a strong anti-father bias and much of the blame for our ever-increasing  fatherless society can be laid at its feet."

The increased levels of violence against women are directly linked with the increase of fatherlessness in Australian society. 80% of rapists are fatherless and 85% of youths in prison are fatherless. The court says it is fighting violence against women and children but through the promotion of fatherlessness in its judgements, it is ensuring the reverse is actually the case.

Marsh continued, "The introduction by Justice Lionel Murphy of no-fault divorce in 1975 through the family law court has been a disaster from the beginning. We are drowning in a tsunami of moral relativism. 'Fault' cannot be legislated out of existence by the whim of the parliament or the court.  'Fault' must always be apportioned. After 1975 the 'new fault' in family law became the 'male of the species'. It is still the case today."

Mr Marsh also said, 'The Family Law Court refused to listen to the wishes of the Labor Government parliamentary reform in 1995 to introduce a fairer, more equitable system for children, mothers and fathers. Now the Family Law Court is again finding fault with the common sense parliamentary reform initiated by the Liberal Government in 2006."

The Dads4Kids Fatherhood Foundation agrees with the words of the Shared Parenting Council, "The Family Law Court has passed its use-by date and its work should be given to the Federal Magistrates Court". The Family Law Court has always operated as a law unto itself. It has shown itself by these recent comments to be above the wishes of the people and the Parliament of Australia and should be abolished at the earliest opportunity.
