Interim Orders

I have had legal advice that if there is a 50/50 agreement in place - even if there is a lot of conflict between the parents - that the FMC will not issue interim orders that are anything but 50/50.

Can anyone share any experiences where this has or has not been the case?

I hope you did not pay for that advice.

Cases are decided on merit and practicality not on a mathematical formula.

Conflict and its degree and how much it would affect the children is a case by case issue.

There is plenty of current case law on this site.

Unfortunately I think I may have to.

I signed consent orders for a temporary period (til the FMC interim hearing) based on being given that advice. My REAL solicitor is fuming, this other guy was a stand-in for a stand-in and on the day, I really didn't know what else to do.

How on earth did you end up with a "stand in for a stand in"??

Was the said "stand in" from the same firm as the one you call your 'real' solicitor? Or are we talking legal aid?

Depending what state you are in you may have some recourse on legal fees here.

Love to hear some clarification. I believe there are several solicitors on here. May be able to help you ascertain whether you have any avenues.

Gee after 3 months here you might have learnt.

If you want real privacy you should have joined the SRLR group as their private forums are not even visible except to their members.
