ICL and Trial

Two Days out from our 3 day trial, the magistrate called my lawyer and said she was appointing an ICL. She delayed the trial for 3 months. Am I grasping if I think that this is a good thing? The applicant was late with all affidavits (his initial, any witness affidavits and his responding affidavit) for the trial (he didnt even get his last affidavit in before the magistrate delayed the trial) and has perjured and contradicted himself in numerous areas. Will there be some form of "punishment(for want of a better word)"?

He has also displayed many time wasting behaviours (for example he filed an affidavit at an interim hearing 10 minutes before the hearing) and he is again going to ask for the trial to be delayed. He has had 9 months to prepare for this trial and now he is stating that he needs more time. how can I combat that? This also means that the AVRO hearing which was coming up next month will be delayed (for the 7th time), he is taking that to trial as well (the interim AVRO is almost 2 years old) and if it "runs out" do I have to reapply? Then there is the property settlement which has a window of 5 months left (he refuses to discuss anything and I cant file for that as there is already something in court). Any suggestions re this mess?

If you are legally represented, run a costs argument.

If you are a self rep, mention the time wasting to the FM - perhaps indicating that he is acting in contempt of the court process…worth a try.

Agree with LP. However, they really are focused on the children - not the mother or the father. My ICL friends hate being dicked around by parents!

I have no interest in speaking to them, I want them the freedom to do their job, but I know that the ex is hassling to contact them. He bullies everybody, including the magistrate and yet he is never reprimanded!
