Children of special needs

Hi

I am currently going thru a property settlement and overnight received an email from my solicitor asking to provide all documents relating to my sons medical condition…he is classed as special needs and my lawyer wants every single document relating to diagnosis and treatment. I fail to see what this has to do with the settlement. Seeing as its the weekend I cant phone to ask. Any ideas?

I also have a child with additional "special" needs and basically why they are asking (something I only found out during my 2nd property settlement that this should have been factored into my first) is how these needs will impact on the immediate AND future financial circumstances of the parent in both providing care (i.e. I can not work due to my child's needs which means indefinite low income, no super etc) but also the additional costs related to those needs (e.g.  it could be that you may have to revamp the bathroom, he/she may need special medical equipment…the list goes on).  It will really depend on the conditions/diagnosis and if the condition is treatable, correctional, curable or ongoing.

These are very important to a property settlement. They are called section 75(2) factors.
