Repayment of CSA Overpayments

It's not a crime not to so submit a tax return - there are valid circumstances under which this happens. We are not entitled to know those reasons (privacy) in this case.

As far as duty of care goes - CSA care about the law and the procedures - they don't have the legal ability to make things up because it sounds fair or balanced. If they are operating on the laws and regulations the they should be able to point to them in this case - then it becomes a legal argument.

As far as using tax returns from years ago - that's not on either. It work both ways - latest tax returns tend to show higher incomes so CSA is automatically adjusted usually upwards. In this case th opposite seems to have happened - also old tax returns will show out of date incomes.

If its not against the law to not submit a tax return then why are there penalties against it?

Actually now you mention it Jon - maybe CSA should have a duty of care to all involved which means they take responsibility for leaving people with such little money, or means of address that they resort to suicide.
