'Bitterley' contested proceedings - adjusted by resolution - orders made by consent

Published copy of 'Consent' Orders.

Much mention is made that this was a bitterley contested hearing that ended with consent orders.

A great shame is not knowing what led the parties to 'agree' or how the Court was going to handle the video link up to the UK

This appears to be a very good set of orders for the Husband and clearly shows the imapact the new legislation is having on leveraging order outcomes that are child focused in relation to sharing time. The Husband made the threshold "Shared Parental Responsibility" and I would suggest that the other side new that substaintial time would have been ordered (s65DAA) through a very costly proceedings. I suggest the other side decided to give some leeway and agree to a regime Wed through Monday rather than face a probable defeat and associated costs orders (If allowed).

A pity that we shall not know what caused these proceedings to come to a 'succesful' conclusion.

So many judgments are abbreviated and unless one is is Court - the true flavour of what actually occured is not in the written material. We have great experience of this with people that hide behind the judgment but are very quiet about the true reasons that led to it.
