Court Admits Covert Phone Recordings as Evidence

In this hearing Court determines whether it should use its discretion to admit phone recordings as evidence

Long case with competing claims of domestic violence and child abuse.

The father however covertly recorded some conversations between the himself and the wife, and he placed transcripts of some of the recordings in his affidavit.

The recordings are really-really powerful stuff, with the wife threatening to kill the children unless the father commits suicide.

naturally the wife attempted to have these recordings ruled inadmissible, and on a prima-facie basis they clearly were, but the Court used its discretion to admit them as evidence.

It's a fine balance between comlpying with the evidence act, and averting what could be a murder-suicide.
